			<content:encoded><![CDATA[<p><a href="http://rdsservices.us/wp-content/uploads/2012/02/DR-Money-Pills.jpg"><img class="alignright size-medium wp-image-668" title="Rising Cost of Healthcare" src="http://rdsservices.us/wp-content/uploads/2012/02/DR-Money-Pills-300x225.jpg" alt="" width="300" height="225" /></a>On February 17, 2012, the Centers for Medicare and Medicaid published an updated reimbursement report that identified the payments that have been made to Plan Sponsors from the 5 billion dollars appropriated to this temporary program. As of that date, the funding that was made available to eligible plan sponsors has run out. This leaves thousands of ERRP Plan Sponsors wondering what they should do now.</p>
<p>According to Health and Human Services, reimbursement requests which exceed the program's $5 billion will now be held in the order of receipt, pending the availability of funds that may become available through recoupment of overpayments. As previously reported, Plan Sponsors with reimbursement requests on hold can expect to receive an email notifying them that their reimbursement requests have been placed on hold pending the availability of funds. If you receive such an email, you may call the ERRP Contact Center to obtain updated information on the position of your reimbursement request in the list of held reimbursement requests.</p>
<p>The Centers for Medicare and Medicaid will continue to pay reimbursement requests in the order received until available funds are exhausted. If there are not sufficient funds to pay in its entirety the first reimbursement request that causes the initial exhaustion of the funds available for payment, CMS will partially honor that reimbursement request, and will pay the balance of that reimbursement request if additional funds become available through recoupment of overpayments.</p>
<p>It is extremely important to note that Plan Sponsors who have received funds through this Program must submit an error-free claims list before March 30<sup>th</sup> or you will be at risk of losing the funding you have received, allowing it to become available for another Plan Sponsor. As posted on the last ERRP.gov announcement, absent the submission of such an error-free claim list and a corresponding reimbursement request, CMS will initiate procedures for recoupment of the funds paid to the Plan Sponsor. Funds returned to the Program as a result of recoupment efforts will be used to pay outstanding reimbursement requests in the order in which they were received.</p>

<p>In fact, according to the latest HHS report dated December 2, 2011, over 1,000 plan sponsors who received money from ERRP before October 3<sup>rd</sup>, 2011 have yet to submit a supporting error-free claim list.  This list is required by March 30<sup>th</sup>, 2012.  <strong>Per the ERRP Common Question H1100-15, <em>“if a Plan Sponsor fails to do so by the deadline, then the reimbursed amount will be determined to be unsubstantiated, and CMS will initiate processes to collect such amount back from the Plan Sponsor.”</em></strong></p>

<p>Given the complexity of this review system, many plan sponsors are struggling to provide an error-free claims list to support their ERRP reimbursement Plan Sponsors who submit a detail claim list to HHS must pass through 5 levels of claim audit before receiving an “approval” to submit a reimbursement request.</p>

All claims lists submitted on or after October 3 must be error-free in order for the plan sponsor to submit a reimbursement request, and then be approved for payment. Each claims list submitted by a plan sponsor must pass through this review system, which includes five levels of audit.  If an error occurs at any level, the claims list is rejected before reaching the next level.  If a claims List is determined to be invalid and cancelled from the system, the sponsor must resubmit a corrected claims list.</p>
<p>To substantiate any ERRP reimbursements received to date, plan sponsors MUST submit an up-to-date and error-free claims list by March 30, 2012 and submit a corresponding reimbursement request in support of reimbursements received prior to October 3, 2011<strong>.   Per the ERRP Common Question H1100-15, last updated 09/23/2011,<em> “if a Plan Sponsor fails to do so by the deadline, then the reimbursed amount will be determined to be unsubstantiated, and CMS will initiate processes to collect such amount back from the Plan Sponsor.”</em></strong></p>

<p> The purpose of this Survey was to gain an understanding of the satisfaction level of our clients who utilize our services, and to determine what we need to do as a company to improve. 			<content:encoded><![CDATA[<p>Recently the Department of Health and Human Services (HHS) announced changes to the ERRP reimbursement request process that will improve and streamline the process of submitting claims data. This announcement which came on September 12, 2011, implements a new, fully-automated review system. This new system will provide Plan Sponsors with more detailed and specific feedback about their Claim List submissions. Plan Sponsors will receive claim line level feedback on Claim Lists in the form of a Claim List Response File. Reason codes for errors found in the Claim List will be contained in Claim List Response File rather than be sent to plan sponsors via Email. It is important for Plan Sponsors to understand that they will be unable to proceed through the reimbursement process, and obtain payment approval, if there is even one claim line error in the Claim List Response File.</p>
<p>It is also important to note that on the ERRP.gov website, there have been many updates in recent months to the “Common Questions” and “Reference Materials” tabs providing clarifications on a variety of technical issues. News posted on September 23, 2011, HHS announced new “How Do I” training videos addressing common reimbursement issues that are frequently being encountered by Plan Sponsors.</p>
<p>Lastly, Plan Sponsors should remember that the deadline to submit error-free Claim Lists in support of reimbursements received for 2010, based on a summary of aggregated claims, has been extended from December 31, 2011 to March 30, 2012.</p>

Over the past several months, HHS has hosted their own webinars and made several announcements regarding these new ERRP requirements including changes to claims list formats and multiple updates to their ERRP FAQs. RDS Services is conducting this webinar to review the issues plan sponsors are having regarding the compilation of “error- free” detailed claims data in the required ERRP format. At RDS Services LLC we are experts in data aggregation. This webinar will be beneficial to plan sponsors who have yet to receive subsidy and plan sponsors who have been challenged by the “data aggregation” and “data reporting” requirements. <p>The HHS announcement also stated “We understand Plan Sponsors' interest in receiving ERRP payments as soon as possible, and appreciate your patience while we implement these changes to facilitate error-free submissions and complete these important reviews.”</p>
<p>Please note that zero reimbursements have been approved since April 2011, which is when HHS implemented the new guidance regarding submitting detailed Claim Lists. Plan sponsors have been expressing their frustration with getting the necessary data to meet the new Claim List requirements.  Based on those complaints, ERRP has made several modifications to the Claim List Layouts since April.</p>
<p><strong>Below is a chronology of the most recent announcements from HHS:<span id="more-584"></span></strong></p>
<p>July 15th –</p>
<p>-             All Reimbursement Requests were pended</p>
<p>July 18th -</p>
<p>-              Updated Claim List Layout released</p>
<p>-              New Claim List Common Questions released</p>
<p>-              Updated Ineligible Claims Guidance posted</p>
<p>On July 21st –</p>
<p>-              ERRP Claim List Training Presented</p>
<p>COMMENTS FROM HHS:</p>
<p>During the July 21st training presentation, Deb Weber, the ERRP Center Training and Education Manager, stated the following –</p>
<p>“Claim Lists associated with a Reimbursement Request, are subject to a quality assurance review to ensure that Reimbursement Requests comply with existing program requirements.  The quality assurance review is not the Claim List Response File review, which will take place at a later date.  We originally communicated that the Claim List Response Files would begin in August.  However, that time frame will be rescheduled.  Until such time when the Claim List Response Files are available, we will provide feedback from the quality assurance review currently going on via email.”</p>
<p>“When the Claim List Response Files are sent and we implement that at a future date, each Claim List will be reviewed prior to Cost Summary Reporting, which must take place prior to submitting a Reimbursement Request.”</p>
<p>“It’s important to understand that with the implementation of the Claim List Response File, the Claim List will be scrutinized in more detail for additional error conditions that are not currently included in the Claim List quality assurance review.”</p>
<p>In conclusion, if the Claim List submission passes the quality assurance review, the Reimbursement Request will be processed.  If it does not pass the quality assurance review, it will be rejected and the corresponding Reimbursement Request will be cancelled.  Again, the processing time to review Claims Lists is now four to eight weeks. </p>
<p>If a Reimbursement Request is cancelled, the plan sponsor will receive an email notification explaining that Claim List errors were found and the claim submission process would start all over again.</p>
<p>In addition to longer processing times for reimbursements, there are other consequences resulting from the submission of Claim Lists with errors. Most notably, each such corrected Reimbursement Request will be considered a new request for reimbursement and evaluated as such for purposes of reimbursement. The submission of a flawed Claim List does not preserve the original position for the Plan Sponsor in the sequence of reimbursement requests waiting processing.</p>

One of the most common adjustments plans will run across are drug rebates. The HHS release identifies several acceptable methods to allocate such “drug rebates”.  An example of an acceptable method for allocating a drug rebate would be to use a “master percentage” calculated based on the estimated annual rebate total for a “plan” over the total prescription drug spend for that plan. It will be acceptable to apply an estimated percentage and calculate an estimated rebate for each claim in your claim file for each eligible “early retiree member”. To complicate matters further, the database of early retirees that you maintain will have to account for both the “gross” drug claim cost as well as the “net” drug claim cost since the “Cost Summary Report” you need to send HHS requires the accumulation of claim data for an eligible early retiree on a “net” cost basis. However, the detailed claim file that you need to send HHS must provide both a “gross” cost claim file as well as a separate “cost adjustment” file; the two files when netted should equal your Cost Summary Report’s “net” cost totals.</p>
<p>Moreover, the guidance released makes it clear that HHS expects plans that today receive a “retiree drug subsidy” to identify the portion of “received” subsidy to a “Medicare eligible” spouse or dependent of an “early retiree”, since spouses and dependents of early retirees ARE eligible under ERRP.</p>
<p>Lastly, if a plan’s actual rebate total for a plan year (which may not be identified until well after the end of the plan year) is different from the estimate used at the time of the original ERRP “request for reimbursement”, then a plan must re-run the claim files with the NEW rebate percentage and re-submit their “request for reimbursement” for what may possibly be a closed plan year.</p>
